I've been using MP3tune.com's music storage service for almost a year and am perturbed to learn that music giant EMI has sued this small company charging "willful infringement of copyright." You can read about it here and download the complaint here. According to EMI, customers shouldn't be allowed to store a copy their own, purchased digital music for their own personal use. What's next - suing the makers of blank CD-ROM and DVD disks or external hard drives? What can you do to help? Jeez - the product is called "Music Locker," as in secure and protected! It is not a P2P system, nor does it make it possible to share music torrent-like with strangers. EMI should spend its efforts to find better A&R people. Here's a suggestion: Clive Davis is available....

Perhaps she means that until now she has been completely poll-driven, scripted, and insincere. But wait - we already knew that!

If she's being truthful (which is always in doubt), then shouldn't she have know about the way the Iowa caucus process "disenfranchises" groups of voters from the start? Why did she participate at all? Why didn't she lead a protest to bring some change to the system - isn't that what she claims she's so good at? Don't the Democrats believe that "every vote counts, and every vote should be counted"?

That seems to be the implication of Mike Huckabee's attack ad against Mitt Romney that, among other "facts," points out that Romney presided over zero executions as Massachusetts governor. Nevermind that Massachusetts does not have the death penalty. So when Huckabbee lumps "no executions" with "left office with a deficit" and "supported gun control," his criticism begs a question about how he reconciles his own record of 16 executions his espoused belief in the sanctity of life - which he recited on this past Sunday's Meet the Press:

It's not a faith belief. It's deeper than that. It's a human belief. It goes to the heart of who we are as a civilization. If I believe that your intrinsic worth is not changed by your ancestry, your last name, by your IQ, by your abilities or disabilities, if I value your life and respect it with dignity and worth because it is human, then that's what draws me to the inescapable conclusion that I should be for the sanctity of every and each human life.

I don't know why Tim Russert didn't challenge him about this apparent contradiction. Maybe another journalist will follow-up, but I'm not holding my breath.

I have been a fan of JetBlue for more than two years, and this latest crisis has me wanting to run to its defense. One of my first impressions of the airline was watching CEO David Neeleman handing our headsets as customers boarded in Boston. Ever since I've been impressed by the company's attention to creating a positive customer experience.

As part of a service recovery initiative, Neeleman has announced a "Passenger Bill of Rights" and sent out the following e-mail apology:

Dear JetBlue Customers,
We are sorry and embarrassed. But most of all, we are deeply sorry.

Last week was the worst operational week in JetBlue's seven year history. Following the severe winter ice storm in the Northeast, we subjected our customers to unacceptable delays, flight cancellations, lost baggage, and other major inconveniences. The storm disrupted the movement of aircraft, and, more importantly, disrupted the movement of JetBlue's pilot and inflight crewmembers who were depending on those planes to get them to the airports where they were scheduled to serve you. With the busy President's Day weekend upon us, rebooking opportunities were scarce and hold times at 1-800-JETBLUE were unacceptably long or not even available, further hindering our recovery efforts.

I've just installed Outlook on the Desktop, a freeware application by a young Canadian programmer named Michael Scrivo that, well, lets you use Microsoft Outlook as the background on your desktop. You can set it to the calendar and then switch among the other Outlook tools (Tasks, Notes, etc.) to get a quick overview as needed. Not only will it save some time by providing info at a glance, but it's cool too.

The Inspiring Words of Our Next President

Senator Barack Obama gave the keynote at a faith-based conference this morning. Hillary is probably still quaking in her Manolo Blahniks. After making the case for progressives to stop hiding their faith or being critical of others', he turned to the Christianists. Conservative leaders, he said,

need to understand the critical role that the separation of church and state has played in preserving not only our democracy, but the robustness of our religious practice. Folks tend to forget that during our founding, it wasn't the atheists or the civil libertarians who were the most effective champions of the First Amendment. It was the persecuted minorities, it was Baptists like John Leland who didn't want the established churches to impose their views on folks who were getting happy out in the fields and teaching the scripture to slaves. It was the forbearers of the evangelicals who were the most adamant about not mingling government with religious, because they did not want state-sponsored religion hindering their ability to practice their faith as they understood it.

Moreover, given the increasing diversity of America's population, the dangers of sectarianism have never been greater. Whatever we once were, we are no longer just a Christian nation; we are also a Jewish nation, a Muslim nation, a Buddhist nation, a Hindu nation, and a nation of nonbelievers.

And even if we did have only Christians in our midst, if we expelled every non-Christian from the United States of America, whose Christianity would we teach in the schools? Would we go with James Dobson's, or Al Sharpton's? Which passages of Scripture should guide our public policy? Should we go with Leviticus, which suggests slavery is ok and that eating shellfish is abomination? How about Deuteronomy, which suggests stoning your child if he strays from the faith? Or should we just stick to the Sermon on the Mount - a passage that is so radical that it's doubtful that our own Defense Department would survive its application?

Looks like there's a little more room in the closet now that Pastor Ted Haggard has finally fessed up after days of denying allegations that he enjoyed regular sessions with a male prostitute. It's easy to attack his hypocrisy for railing against all things gay publicly while enjoying its pleasures privately. Sully, as usual, highlights the real sin:

I think it's important to keep perspective. At least based on what we know now, he didn't rape, assault, or otherwise injure anyone. The underage pages - erroneously referred to by some as "young boys" -- were 15 and 16 years old. In many states, that's old enough to be tried as an adult for murder or to get an abortion without a parent's consent or even knowledge.

My satisfaction with time-saving and cool applications like ClearContext has me searching for others. I've been playing with Tidy Start Menu, which does one thing very well: more easily organize my Windows Start menu. Until now, whenever I added an application, or updated a previous one, the new folders and shortcuts messed up my previous organization of links. After a significantly distracting amount of clutter had developed, I'd right click on Start/Programs/ Explore All Users and move things around. To get things right I usually had to double check the default user and administrator folders as well.

Tidy Start Memo makes the task a whole lot simpler and the results are considerably better. I like that I can choose custom icons, and the best feature is that you can delete an app by simply right-clicking on it. Download the free version and give it a try.

My brother is a senior at CU Boulder and works in the freshman orientation office. This week, he and his coworkers were trying to assist a young woman who was having difficulty locating a building in which she said she had been instructed to attend an orientation session. When she said the name of the building was Braiden Hall, the orientation crew told her that it sounded familiar, but that it definitely wasn't a CU building. "Let me see your acceptance letter," one person asked her. After looking at the letterhead, the mix-up became clear. "Miss, I believe you've been accepted to Colorado State. In Ft. Collins." She had been looking for the CSU Student Union. The mortified young lady's face dropped. "But I just signed a lease!" she said, then fled immediately.

After years of hoping while studios released every two-bit, dimwitted B movie in their vaults, I am so excited that Paramount is finally issuing REDS on DVD. The 25th Anniversary of the film - one of my all-time favorites (I saw it at least 7 times during its initial release, including back-to-back showings - yes I was obsessed!) - was the peg they were waiting for, I suppose. Will its Oscar-winning director Warren Beatty do any press to push sales? Doubtful, but who cares?! Now, if I could only find more information about what extras, if any, are being included. It seems to me that there is plenty of room on a second (or third!) DVD for the witness interviews in their entirety; is that what the purported 6-part documentary consists of? Well, one can hope...

P.S. Note to Paramount: it's time to update your web site, don't you think? There's no mention of this DVD's October 3 drop.

Braces, Day One

So I had my orthodontic braces installed (or whatever the appropriate verb is) this morning. All went smoothly, and it even took less time than I had thought. The brackets and wires feel awkward, but the staff assure me that within a week or so I'll adjust. Fine. And the Aleve is working like a charm so far.

Fast forward two hours when I'm ready to sit down for my first meal with my new mouth. TWACK! I felt the top wire shift to the left, and suddenly the subtle pressure I'd been feeling on my teeth is gone. With my tongue I can feel the sharp edge of something metal; that wasn't there before, was it? Quick trip to the mirror reveals that one of the brackets had come off a tooth.

The orthodontist's receptionist didn't seemed too fazed when I told her my problem; I was offered an appointment for TOMORROW afternoon. Was she kidding? I just had them put on less that three hours ago; couldn't someone fix it today? Time is of the essence - I don't want to spent one day longer than necessary with these things. I'll be seeing someone (who knows what they're doing, I hope), later this afternoon.

Not an especially propitious start, but I'll give them the benefit of the doubt on this one. I am in Boulder after all, where "no worries" is our mantra.

Those judicial activists are at it again. In a six to one vote, the Massachusetts Supreme Judical Court has upheld a 1913 law banning marriages to out-of-staters if the marriage would not be legal in their home state. Sullivan argues that this should end all pushes for constitutional amendments, state or Federal, since with this ruling Massachusetts has essentially saved them the trouble. But he ignores those in my situation: I'm legally married in Massachusetts but may or already have moved to another state. How is it just in this "e pluribus unum" nation that for so fundamental a piece of my identity I can have a different legal status depending in which state I reside. Are marriage laws simply like any other statute - those defining criminal offenses or zoning requirements, for examples - or are they intended to protect "the bedrock of society"?

Last weekend in Nashville Gov. Romney repeated an insult against gay & lesbian parents by asserting that "every child has the right to a mother and a father." Today he acknowledges that we have "a legitimate interest" in adoption. Gee, thanks Gov.! Never mind that Massachusetts law specifically allows gay adoption, including second parent adoption. This, from a Harvard Law grad. Romney's flip-flop reminds me of his stance on abortion. During his campaign for governor he said he supported the current Massachusetts law on abortion. Now that he's seeking the republican nomination for the presidency, his view has "matured" and he is now anti-abortion. Well, at least he's mastered the political art of pandering....

Others may have been surprised, but I expected Crash to beat Brokeback for Best Picture.

Overall, the show was about average, continuing the recent tradition of minimal spontineity, few surprises, and just one moment for the history books.

I thought Jon Stewart did a fine job, and certainly deserves to be asked back. The Daily Show-inspired Oscar "campaign" ads were a hoot, but the zingers were few and far between.

Oh, well - let's do this again in 12 months!

I remember saying after she accepted the SAG award that Reese Witherspoon just won herself the Oscar. Her speech then, just like the one she gave tonight, was sincere, thoughtful, delivered with confidence and a minimum of distracting tears, and offered a paeon to her chosen profession. Who could ask more in such a speech? Wasn't Philip Seymour Hoffman listening at the SAGs?

As expected, Philip Seymour Hoffman won Best Actor, and also as expected he wasted his time on the stage. I don't get it: he's a great actor, who knows lots of great writers (Paul Thomas Anderson and Anthony Minghella, to name a few) yet made lame acceptance speeches at the Globes, SAGs, and even yesterday's Independent Spirit Awards. Why didn't someone who cared about him sit the man down and get him to think about what he would say when (not if) he won the Oscar?

WOW! Meryl Streep and Lily Tomlin just showed us what pros can do when given great dialogue, some rehearsal, and of course, great talent. Their introduction of Robert Altman's Special Oscar will go down as one of Oscar's greatest. Jon Stewart started slow and a bit hesitantly, but seemed to relax by the end of what was an average monologue. The video montage of the history of gay overtones in cowboys movies was reminiscent of portions of The Celluloid Closet.

Loved Nicole Kidman's reference to the nominees as "all leading men," and Best Supporting Actor goes to George Clooney. Will his thoughtful speech, without this list of thank yous, be a model of things to come?

Animated Feature: Wallace & Gromit in The Curse of the Were-Rabbit

I'm going out on a limb with several of these - and I wouldn't be surprised to see Brokeback for Best Picture, Reese Witherspoon (Actress), George Clooney (Supp. Actor), and Rachel Weisz (Supp. Actress) win instead. Nothing will make me cheer more loudly than if Amy Adams wins - the supporting actress category has been a wild card in the past and as prone to recognize great performances (e.g., Marsha Gay Harden in Pollack) as well as payback (e.g., Judi Dench in Shakespeare in Love) and hers is the best BY FAR - if only the voters took the time to watch it.

We'll know before too long.....

I'm all hepped up over high-fructose corn syrup (HFCS), and last week's trip to the grocery store pushed me over the edge.

Did you know that most commerically produced bread - the kind most Moms in America buy for the kids' lunches, including the supposedly-healthy whole grain types - is made with HFCS? I sure didn't, and believe me you have to read a lot of lables to find the few varieties of non-organic, reasonably priced bread to find one made with honey or cane sugar instead.

There's no excuse for the stupid and insensitive delay by officials at International Coal Group in getting the tragic truth to miners' family members. Nevertheless, lost in all the hand-wringing is a mea culpa from the media, who based reports of the miners' survival on secondhand accounts and other unconfirmed sources. The incident reminds me of the moment during live coverage of the attempted assassination of President Reagan when a clearly angered and frustrated ABC News anchor Frank Reynolds berated his producers by sharply demanding, "Let's get it NAILED DOWN...somebody...let's find out! Let's get it straight so we can report this thing accurately!" Time to send these folks back to j-school.
